Digital Goods Licensing Terms of Service

NOTE: THESE DIGITAL GOODS LICENSING TERMS OF SERVICE INCORPORATE BY REFERENCE THE DOCOMO PRIVACY POLICY AND TERMS OF SERVICE, WHICH INCLUDES A BINDING AND ENFORCEABLE ARBITRATION PROVISION, AND A CLASS ACTION/JURY TRIAL WAIVER. ANY DISPUTES ARISING OUT OF OR RELATING TO THESE DIGITAL TERMS OR ANY DIGITAL GOODS SHALL BE RESOLVED IN ACCORDANCE WITH THE ARBITRATION PROVISION IN THE TERMS OF SERVICE.

These Digital Goods Terms of Service (“Digital Terms”) govern your access to and use of the Digital Goods (as defined below) available on the MANGA MIRAI websites at https://mangamirai.com/, and any sub-domains thereof (the "Service Website"), and the MANGA MIRAI Mobile Application (the "Service App" and together with the Service Website, the “Platform”). The Platform is operated by NTT DOCOMO, INC. (referred to as “DOCOMO”, “we”, “our” or “us”).

These Digital Terms are subject to change without prior written notice at any time in our sole discretion. Any changes to these Digital Terms will be in effect as of the “Last Updated” date referenced above. Your initial access to, and continued use of Digital Goods on or after the Last Updated date will constitute your acceptance of and agreement to these Digital Terms.

Digital Goods available through the Platform are offered and available in the United States and to users who are at least sixteen (16) years of age and who reside in the United States. Users below eighteen (18) years of age must obtain the consent of their parent, guardian or legal representative before accessing Digital Goods. If you do not meet these requirements, please do not access or use the Platform or any Digital Goods available on the Platform. While the Platform and Digital Goods may be accessed from outside the United States, DOCOMO makes no guarantees regarding their use or functionality outside of the United States. Furthermore, DOCOMO will not be liable for any damages you incurred as a result of accessing the Platform or Digital Goods from outside of the United States.

Digital Goods

The term "Digital Goods" refers to any and all digital audiovisual work, digital audio work, digital books, digital code, or digital applications or games, whether electronically or digitally delivered or accessed, such as books, manga, Comics (as defined in the Terms of Service), newspapers, magazines, games, music, videos, movies, digital art, digital illustrations, or any codes (such as QR/coupon codes or points or other rewards) used to obtain access to any Digital Goods, accessed through or made available to you on the Platform.

License for Digital Goods

Pursuant to these Digital Terms, and upon receipt of any required payment(s) if applicable, DOCOMO, as licensor, provides you, as licensee, a personal, nontransferable, non-exclusive, fully revocable, limited license to use, view, display, download, or otherwise access Digital Goods. The Digital Goods are being licensed, not sold, to you, and we retain the rights, title and interest in the Digital Goods. Your license to use, view, display, download or otherwise access the Digital Goods is conditioned upon your compliance with these Digital Terms. DOCOMO reserves the right to immediately revoke your license to the Digital Goods at any time, and for any reason whatsoever, including your breach of these Digital Terms.

ALL DIGITAL GOODS ARE PROVIDED "AS IS". DOCOMO MAKES NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. YOU ASSUME FULL RISK OF YOUR USE OF THE DIGITAL GOODS.

Licensee Rules and Restrictions

Your license to use, view, display, download, or otherwise access Digital Goods is subject to the following rules and restrictions.

  • Unless specifically stated otherwise, you may not reproduce, copy, distribute, modify, create derivative works of, reverse engineer, reverse assemble or otherwise attempt to discover any source code, publicly display, publicly perform, republish, download, store, or transmit any Digital Goods except that: (i) your computer may temporarily store copies of such materials in RAM incidental to your accessing and viewing those materials; (ii) you may store files that are automatically cached by your internet browser for display enhancement purposes; and (iii) if we provide social media features with certain content, you may take such actions as are enabled by such features;
  • You may not sell, rent, lease, distribute, broadcast, sublicense, or otherwise assign, transfer, or convey, any rights in the Digital Goods or any portion thereof to any other person, entity, or third party;
  • You may not alter, deface, revise, amend, or otherwise modify the Digital Goods in any way;
  • Digital Goods may not be used for any commercial, promotional, endorsement, advertising, or merchandising use or purpose;
  • You must use any and all Digital Goods in accordance with any and all applicable local, state, federal law, and international law, including but not limited to copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws, false advertising, unfair competition, defamation, invasion of privacy, or any rights of celebrity;
  • You may not use the Digital Goods as part of any effort to compete with us or otherwise use the Digital Goods for any revenue-generating endeavor or commercial enterprise;
  • You may not use the Digital Goods to harass, abuse, intimidate, threaten or harm another person;
  • You may not delete the copyright or other proprietary rights notice from the Digital Goods;
  • You may not use the Digital Goods to infringe on any person's intellectual property rights.

Intellectual Property

The Digital Goods, together with their code, sequences, organization and structure, documentation, data, or any other materials, are owned by DOCOMO, our licensors, affiliates, contractors, partners, or other providers of such material, are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

No right, title, or interest in or to the Digital Goods is transferred to you, and all rights are reserved by us. Any use of the Digital Goods not expressly permitted by these Digital Terms is a breach of these Digital Terms and may violate copyright, trademark, and other laws.

Costs, Charges, or Fees to Access Digital Goods

DOCOMO may impose costs, charges, or fees to obtain, access, view, or otherwise use certain Digital Goods ("Access Fee"). You understand and agree that all Access Fees are final and non-refundable unless required by law or as otherwise provided by the applicable app store platform from which you downloaded the Service App (e.g., Apple App Store, Google Play) ("App Store Platform"). You authorize us to charge the payment method associated with your account for the amount of the Access Fee which payment shall be processed by our third party payment processor, Stripe, and shall be subject to Stripe's Consumer Terms of Service (https://stripe.com/legal/consumer). Please refer to Stripe's Consumer Terms of Service and Privacy Policy (https://stripe.com/privacy) for information on how your personal information is handled when processing the Access Fee.

No Cash Value

Your rights and ability to obtain, access, view, or otherwise use Digital Goods made available to you through the Platform, whether for a fee or otherwise, have no cash value. We reserve the right to manage, regulate, control, modify, or eliminate any and all Digital Goods at any time without compensation.

Termination

We may terminate your rights and ability to obtain, access, view, or otherwise use Digital Goods at any time, with or without notice, for any reason or no reason, including but not limited to violation of these Digital Terms.

Complete Terms and Conditions

These Digital Terms incorporate by reference the Privacy Policy and Terms of Service as though fully set forth herein, including, but not limited to any terms governing dispute resolution, representations and warranties, limitations of liability, disclaimers, and governing law. These Digital Terms together with the Privacy Policy and Terms of Service constitute the entire agreement governing your license to use, view, display, download or otherwise access Digital Goods. In the event of a disagreement between these Digital Terms and the Terms of Service, these Digital Terms shall govern your license to use, view, display, download or otherwise access Digital Goods.
